iMLS LLC Privacy Policy

This Privacy Policy (this “Policy”) describes how iMLS, LLC and its subsidiaries or affiliates (collectively, “iMLS, LLC,” “Real Estate Tools,” “we,” “us,” or “our”) gather and use information collected from you when you use www.RealEstateTools.com and affiliated websites (collectively, the “Website”), the iMLS, LLC mobile applications (the “App”) or any other products, services or features offered by iMLS, LLC (collectively, the “Services”). We understand the importance of your privacy and, accordingly, treat all information that we receive from you in a responsible manner. By using, downloading or accessing the Website, App Services, you agree to be bound by this Policy. If you do not agree to the terms of this Policy, you are not permitted to use, download or access the Website, App or Services. Each time you use the Website, App or Services, the current version of this Policy will apply. Accordingly, when you use the Website, App or Services, you should check the date of this Policy and review any changes since the last version.

INCORPORATION

This Policy is incorporated into and is subject to the iMLS, LLC Terms of Use. Your use of the Website, App and Services and your provision of any information, including without limitation personal or location information, to iMLS, LLC is subject to the terms of this Policy and the Terms of Use.

TYPES OF INFORMATION WE COLLECT

iMLS, LLC may collect two types of information from users of the Website, App or Services: “personal information” which is information that can be used, either alone or in combination with other information available to iMLS, LLC, to locate you, contact you, or determine your specific identity (including, without limitation, your name, account login information and password, e-mail address, mailing address, phone number, location, any content you post to the Website or App, etc.) and “aggregate information” which is information about your activities in connection with the Website, App and Services that web browsers and servers typically make available (including, without limitation, as browser type, language preference, referring site, frequency of visits to the App and the date and time of each visit, data entered when using the Website or App, Website or App pages or functionalities most frequently accessed, etc.).

COLLECTING YOUR PERSONAL INFORMATION

iMLS, LLC collects personal information that:

  • you provide when you sign up for a Real Estate Tools account, use the Website or App or download the App
  • you allow us to collect from your use of certain features
  • you post through the Website or App
  • you allow us to collect from other social media services
  • we get from seeing you use the Website or App
  • we get from communicating directly with you
  • we get from cookies and other technology

Specifically, when you sign up for an account, we ask you for your name and email address, among other information. Because the App is built on a mobile device platform, we may also have access to other information such as the location(s) where you use the Website or App if you choose to share that information with us.

If you create your Real Estate Tools account using Facebook authentication, we pull in your birthday, email address and profile picture if they are available to us from your Facebook profile. All of these can be changed later in your settings. When you connect your account to Facebook, we store some information (access token, your ID and the names and IDs of your friends) so that we can find which of your friends are using Real Estate Tools or let you know if they join in the future. If you choose to disconnect your Facebook account from Real Estate Tools, which you can do at any time, we delete this information from our servers.

You may modify or remove any of your personal information at any time. However, if you remove information that you posted to the Website or App, copies may remain viewable in cached and archived pages of the Website or App, or in the possession of other users or third parties that have copied or saved your personal information.

LOCATION INFORMATION

Some Services, including without limitation the App, require you to disclose certain location information. Location information includes, but is not limited to, any information we derive in order to identify your geographic position. This information may be collected from your wireless carrier, certain third party service providers or directly from the mobile device that you previously registered for use with iMLS, LLC. The collection and tracking of your location information may occur even when the App is not actively open and running. Your location information, however, is only displayed and shared in accordance with your established privacy settings.

We may combine the personal information and/or the location information that your submit under your account with information from other Services or third parties in order to provide your with an enhanced experience and/or to improve the overall quality of the Services. For certain Services, we may give your an opportunity to opt out of the combination of such information.

COLLECTING YOUR AGGREGATE INFORMATION

Aggregate information is collected as you use the Website or App or interact with the Services even if you do not enter any information. Generally, aggregate information is used in a collective manner, and no single person can be identified by such compiled information. iMLS, LLC uses aggregate information to provide the Services, as well as to determine the use of the Website and App and to monitor, audit and analyze information pertaining to our business metrics. From time to time, iMLS, LLC may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of the Website or App.

USING, SHARING, SELLING AND TRADING OF YOUR PERSONAL INFORMATION WITH THIRD PARTIES

In addition to the purposes described in this Policy, we may use the information that we gather from or about you to, among other things, (i) operate, maintain and provide to you all of the features of the Website, App and Services, including the display of customized content and advertising, (ii) provide the basic functionality of the Website and App, including without limitation displaying your live location and movement, (iii) improve the features and functionality of the Website, App and Services, (iv) employ “reverse geo-coding” and your IP address or saved location information to provide you with specialized event content, (v) communicate with you about any questions or requests you submit to iMLS, LLC, (vi) provide you with information and notices related to the Website, App and Services, (vii) provide relevant marketing and other information to you, (viii) invite you to participate in surveys conducted by iMLS, LLC or its affiliates, (ix) develop new products and services, and (x) improve marketing and promotional efforts.

In some instances, we may be obligated by law to share certain of your information with legal authorities. In addition, on occasion, we may share personal information with third party service providers as we deem necessary for the third party to fulfill its duties, such as fulfilling orders, processing credit card payments, or other functions necessary to our business. These third party service providers are not authorized to retain, share, store or use your personal information for any purposes other than to provide the services for which they have been hired to provide.

When you submit your personal information, you also agree that we may use your personal information to contact you by email, telephone, cell phone, direct mail, or text message about new features, to solicit your feedback, to keep you up to date with what’s going on with iMLS, LLC and our products or about certain offers made available by us or third parties that we believe you might be interested in based on information you have provided to us. We do not sell, trade or otherwise share your personal information with unrelated third parties for their own marketing purposes; however, we may market certain offers to you on behalf of third parties we determine that you might be interested in.

SHARING, SELLING AND TRADING AGGREGATE INFORMATION COLLECTED ONLINE WITH THIRD PARTIES

We may use aggregate information to improve the Website, App and Services, to monitor traffic and general usage patterns, and for other general business purposes. We may disclose aggregate information to third parties for a variety of business reasons, including to advertisers to inform them of the usage habits or characteristics of the interested audience, and to potential investors so that they may better understand our user base, etc. Aggregate information will not include any personal information, and we will not disclose any personal information except as expressly stated elsewhere in this Policy.

OTHER INSTANCES WHEN WE SHARE YOUR INFORMATION

In addition to the foregoing, iMLS, LLC may elect to share or transfer your personal information to unrelated third parties (i) to comply with a legal requirement, judicial proceeding, court order, or legal process served on iMLS, LLC, (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of iMLS, LLC; (iv) when we believe it is necessary to protect the rights, property, or safety of iMLS, LLC or other persons, or (v) as otherwise required or permitted by law.

It should be noted that on some portions of the Website or App, users can choose to have their personal information displayed. If users choose to have their personal information displayed on the Website or App, they will be given forewarning that the action they are about to take will make their personal information publicly available on the Website or App.

PUBLIC SHARING OF YOUR CONTENT

Any information or content that you voluntarily disclose for posting to the Website or App, such as user content, becomes available to the public, as controlled by any applicable privacy settings that you set. To change your privacy settings on the Website or App, please change your profile setting. Once you have shared user content or made it public, that user content may be re-shared by others. Subject to your profile and privacy settings, any user content that you make public is searchable by other Website or App users and subject to use under our Terms of Use. If you remove information that you posted to the Website or App, copies may remain viewable in cached and archived pages of the Website or App, or if other users or third parties have copied or saved that information.

COOKIES OR SIMILAR TECHNOLOGIES; DEVICE IDENTIFIERS

If you do not provide us any of your personal information, we are limited in the information we may collect from you. For example, we may be able to determine your IP address for the purposes of administering the Website or App and tracking Website and App usage. However, your IP address may vary each time you visit or it may remain the same depending on the type of Internet connection you are using or the location from which you access the Website or App. We aggregate information to help us to compile reports as to trends and other behavior about users of the Website or App; however, such information is generally anonymous and not tied directly to you.

We may also use “cookies” or similar technologies such as pixels and beacons and your personal information to enhance your experience on the Website or App and with our Services and to provide you with personalized offers. A cookie is a small data file placed on your computer’s hard drive that contains information that allows us to identify you and track your activity on the Website or App, your usage of the Website or App and your access preferences. The cookie itself does not contain any personal information; however, if you provide us any personal information, the cookie may act as an identifier to tie your personal information to your IP address or computer. You may choose to delete cookies from your computer’s hard drive at anytime or to disable cookies on your computer. If you delete cookies that relate to the Website or App, we may not be able to identify you upon your return to the Website or App. Additionally, if you disable your computer’s cookies, you may not be able to access certain features of the Website or App or Services that require that cookies be enabled. The Website’s and App’s cookies cannot be used to read data from your hard drive and cannot retrieve information from any other cookies created by other websites. Additionally, our cookies cannot be used as a virus, Trojan horse, worm, or any other malicious tool that could impair your use of your computer. Our cookies are used to help us better understand how you and other users use the Website and App so we can continue to provide a better, more personalized user experience on the App. We also share Website and App usage information about our Website and App with those interested in running targeted promotional campaigns on the Website or App. For this purpose, we and our advertisers track some of the pages that you visit on the Website or App through the use of pixel tags (also called clear gifs).

When you use a mobile device like a tablet or phone to access the App and our Service, we may access, collect, monitor, store on your device, and/or remotely store one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by iMLS, LLC. A device identifier may deliver information to us or to a third party partner about how you browse and use the App and may help us or others provide reports or personalized content and ads. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

LOG FILE INFORMATION

When you access or use the Website, App or Services, our servers automatically record information from your mobile device and web browser. These server logs may include, but are not limited to, information such as your web requests, Internet Protocol address, browser type, browser language, the date and time of your request, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, cookies that may uniquely identify your browser, and elements employed in the Website or App.

THIRD-PARTY ADVERTISERS AND AD-SERVING COMPANIES

Advertisements that appear on the Website or App are sometimes delivered (or “served”) directly to you by third-party advertisers or ad network companies. These companies may automatically receive your IP address or other information about your mobile device or personal computer when serving advertisements. These third parties may also download cookies to your computer, or use other technologies such as JavaScript and “web beacons” (also known as “1×1 gifs”) to measure the effectiveness of the advertisements served and to personalize advertising content. Doing this allows the advertiser or ad network to recognize your computer or mobile device each time an advertisement is sent to you in order to measure the effectiveness of the ad and to personalize advertising content. These companies may compile information about the sites or services visited when seeing advertisements and determine which advertisements are clicked. iMLS, LLC does not access or have control of the cookies that may be placed by third-party advertisers or ad networks. Likewise, third party advertisers and ad networks do not have access to your personal information stored with us unless you choose to share it with them. This Policy does not cover the use of tracking technologies or personal data by any such third-party advertisers or ad network companies.

SECURITY PERTAINING TO YOUR INFORMATION

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to iMLS, LLC employees, service providers and agents who need to know that information in order to operate, develop or improve the Website, App or Services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. We use secure socket layer (“SSL”) technology to encrypt and protect the security of your personal information, including but not limited to your credit card number, when it is sent over the Internet. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security. Transmitting personal information is done at your own risk.

Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and iMLS, LLC, at all times. Your privacy settings may also be affected by changes the social media services you connect to iMLS, LLC make to their services. We are not responsible for the functionality, privacy or security measures of any third party.

INTEGRITY OF YOUR DATA

iMLS, LLC processes personal information only for the purposes for which it was collected and in accordance with this Policy. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve the Services. We take reasonable steps to ensure that the personal information we process is accurate, complete and current, but we depend on our users to update or correct their personal information whenever necessary.

CHILDREN AND PRIVACY

Our App and Website are not directed to children, and we will not request personally identifiable information from anyone who we know to be under the age of 18, unless we have obtained verifiable parental consent from a parent or legal guardian. If we become aware that a user under the age of 13 has registered with our App, provided personal information, and iMLS, LLC has not obtained prior verifiable consent from a parent or legal guardian, we will immediately remove the user’s personal information from our files. IF YOU ARE UNDER THE AGE OF 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SERVICES AT ANY TIME OR IN ANY MANNER.

AFFILIATED SITES

We offer some of the Services in connection with other partners. Personal information that you provide to a partner or its affiliated website may be sent to iMLS, LLC in order to deliver the Services. We process such information in accordance with this Policy. Partners and their affiliated websites may have different privacy policies governing your personal information, and we encourage you to review such privacy policies.

EXTERNAL LINKS

The Website or App may contain links to third party websites operated by other people or companies. Those websites may have their own privacy policy or no privacy policy at all. iMLS, LLC does not have any responsibility for those websites, and we provide the links solely for the convenience of our users.

BUSINESS TRANSFERS

In the event that iMLS, LLC becomes involved in a merger or acquisition or sells substantially all of its assets or one of iMLS, LLC’s business units is acquired, your personal information and aggregate information will most likely be one of the assets transferred or acquired by a third party. You acknowledge that such a transfer may occur and that any such third party or its assets may continue to use your personal information or the aggregate information as set forth in this Policy. In the negotiation of any potential merger, acquisition, or sale of iMLS, LLC, we may share with third parties certain pieces of aggregated, non-personal information. Such information does not identify you individually. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred or used.

CHANGES TO THIS POLICY

We may change this Policy at any time and without prior notice by posting the revised version of this Policy on the Website or App. Your continued use of the Website, App or Services indicates your consent to our collection of and use of your personal and aggregate information under the then current Policy.

INFORMATION CORRECTIONS AND REMOVAL

If your name, e-mail or mailing address, telephone number or other personal information changes, you may update, correct or omit the relevant information by contacting iMLS, LLC, provided that such information may only be omitted if it is not otherwise required to be retained by law, or for legitimate business purposes. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

OPT-OUT

If you prefer not to receive newsletters or other e-mails from iMLS, LLC, please let us know by clicking on the unsubscribe link within any newsletter or marketing e-mail you receive, as applicable. Please note that any service-related emails generally do not offer an option to unsubscribe as they are necessary to provide the service you requested. If you prefer not to receive marketing mail via the mail carrier, please let us know by contacting customer service. Please be sure to include in any e-mail your full name, e-mail address and any message. Please note that such requests may take up to ten (10) days to become effective.
